Privacy Policy.
Webperties LLC, a Florida limited liability company (“Webperties,” “we,” “us” or “our”), respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit webperties.com or any page or form that links to this policy (together, the “Site”), and the choices and rights available to you.
This policy does not apply to information we process on behalf of clients under a separate written agreement, or to other websites, including other websites we own or operate, which are governed by the privacy policies posted on them. Capitalized terms not defined here have the meaning given in our Terms of Use.
1. Information We Collect
Information you provide to us
- Contact and professional details. When you submit a form on the Site, we collect your first and last name, email address, phone number, company name, and role.
- Communications. The content of emails, calls, and other messages you exchange with us, and any information you choose to include in them.
- Client account information. If you are an authorized user of our Client Login, your login credentials and information associated with your account.
Please do not send us sensitive personal information, such as Social Security numbers, financial account numbers, health information, or information about racial or ethnic origin, through the Site.
Information we collect automatically
- Device and connection information, such as IP address, browser type and version, operating system, device type, screen size, language settings, and the website that referred you.
- Usage information, such as the pages you view, the links and buttons you click, how far you scroll, mouse movements and taps, the time spent on each page, and the date and time of your visit.
- Approximate location, such as city, region, and country, inferred from your IP address. We do not collect precise geolocation.
- Session replay data. Microsoft Clarity records how visitors interact with pages so we can reconstruct and review sessions and generate heatmaps. We configure Clarity to mask the text you type into form fields.
We collect this information through cookies, pixels, scripts, and similar technologies, described in Section 3.
Information from other sources
- Analytics and advertising partners, such as reports from Google, Microsoft, and Meta about how visitors reach and use the Site and how our advertising performs.
- Search performance data from Bing Webmaster Tools, such as the search queries, impressions, and clicks that lead to the Site. This data is reported to us in aggregate.
- Publicly available business information, such as company websites, franchise disclosure listings, and professional profiles, which we may use to research franchise brands and contact their decision-makers about our services.
2. How We Use Information
We use the information described above to:
- Respond to your inquiries and discuss how we might work together;
- Provide, manage, and support our services and client accounts, and perform our agreements;
- Communicate with you about our services, including business-to-business marketing, which you can opt out of at any time;
- Operate, maintain, analyze, and improve the Site, including understanding how visitors navigate it and fixing usability issues;
- Measure and improve our advertising, including showing ads on Meta platforms to people who have visited the Site;
- Protect the security and integrity of the Site, and detect and prevent fraud, abuse, and unauthorized access;
- Comply with legal obligations, resolve disputes, and enforce our agreements; and
- Fulfill any other purpose we describe when you provide the information, or with your consent.
We may also create aggregated or de-identified information that does not identify you. We maintain and use de-identified information only in de-identified form and do not attempt to re-identify it, except as permitted by law.
3. Cookies, Pixels, and Similar Technologies
Cookies are small text files stored on your device. Pixels (also called web beacons or tags) and scripts are small pieces of code that send information about your visit to us or to a third party. We use these technologies to keep the Site working, to understand how it is used, and to measure and deliver advertising. Some are set by us (first-party); others are set by the providers listed below (third-party).
| Tool | Provider | Purpose | Learn more |
|---|---|---|---|
| Google Analytics 4 | Google LLC | Analytics. Measures visits, traffic sources, engagement, and conversions using cookies such as _ga. Google Analytics 4 does not log or store IP addresses. | How Google uses data |
| Microsoft Clarity | Microsoft Corporation | Analytics. Behavioral metrics, heatmaps, and session replay that show how visitors use the Site. | Microsoft Privacy Statement |
| Meta Pixel | Meta Platforms, Inc. | Advertising. Measures actions taken on the Site after viewing or clicking our ads on Facebook and Instagram, builds audiences of Site visitors for advertising, and helps Meta deliver relevant ads. | Meta Privacy Policy |
| Bing Webmaster Tools | Microsoft Corporation | Search performance. Reports how the Site appears and performs in Bing search. It relies on a site verification tag and Bing’s own search data and does not place cookies on your device. | Microsoft Privacy Statement |
| Cloudflare Turnstile | Cloudflare, Inc. | Security. Runs on our contact form to tell people from automated bots and prevent spam. It checks browser and device signals and does not use cookies to track you across websites or for advertising. | Cloudflare Privacy Policy |
Microsoft Clarity and Microsoft Advertising. We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with the Site through behavioral metrics, heatmaps, and session replay, in order to improve and market our services. Website usage data is captured using first- and third-party cookies and other tracking technologies to determine the popularity of our services and online activity. We also use this information for site optimization, fraud and security purposes, and advertising. For more information about how Microsoft collects and uses your data, see the Microsoft Privacy Statement.
Meta Pixel. When the Meta Pixel loads, Meta may collect information such as your IP address, browser information, the pages you visit, and the actions you take on the Site, and may link it with information Meta already holds about you, including your Facebook or Instagram account. Meta processes this information under its own privacy policy and may use it to provide measurement and advertising services to us and to improve its own products.
Your choices about cookies and advertising
- Cookie settings. Use the “Cookie settings” link at the bottom of every page to accept or reject analytics and advertising cookies, and to change your choice at any time. If you are in the European Economic Area, the United Kingdom, or Switzerland, we ask before setting them.
- Browser settings. Most browsers let you block or delete cookies. If you block cookies, parts of the Site may not work as intended.
- Google Analytics. Install the Google Analytics Opt-out Browser Add-on.
- Meta. Manage how Meta uses data from other websites in your Meta ad preferences.
- Interest-based advertising. Opt out of interest-based ads from participating companies through the Digital Advertising Alliance and the Network Advertising Initiative. Opting out does not stop all ads; it means the ads you see may be less relevant.
- Mobile devices. Use your device settings to limit ad tracking or reset your advertising identifier.
These opt-outs are browser- and device-specific. If you use a different browser or device, or clear your cookies, you will need to opt out again.
Global Privacy Control and Do Not Track
We honor the Global Privacy Control (GPC). When we detect a GPC signal from your browser, we treat it as a request to opt out of the sale or sharing of your personal information and of targeted advertising for that browser, and we do not load the Meta Pixel. Because there is no common industry standard for browser “Do Not Track” signals, the Site does not respond to them.
4. How We Disclose Information
We disclose personal information only as described in this policy:
- Service providers that perform services for us, such as website hosting, email delivery, customer relationship management, analytics, and IT and security support. They are contractually bound to use the information only to provide services to us.
- Analytics and advertising partners listed in Section 3, which collect information directly through their technologies on the Site.
- Affiliates, meaning companies under common ownership or control with Webperties, for purposes consistent with this policy.
- Business transfers. In connection with a merger, acquisition, financing, public offering, reorganization, sale of assets, or bankruptcy, including related due diligence, personal information may be disclosed or transferred to the parties involved.
- Legal and safety. When we believe in good faith that disclosure is necessary to comply with law, regulation, subpoena, or court order; to respond to lawful requests from public authorities; or to protect the rights, property, or safety of Webperties, our clients, users, or others.
- With your consent or at your direction.
We do not sell personal information for money. Some state privacy laws define “sale,” “sharing” or “targeted advertising” broadly enough to include allowing advertising partners, such as Meta, to collect information through pixels on a website. To the extent our use of the Meta Pixel falls within those definitions, you can opt out as described in Sections 3 and 8. We have no actual knowledge of selling or sharing the personal information of anyone under 16.
5. Communications From Us
Email. You can unsubscribe from our marketing emails at any time using the link in the email or by contacting us. We may still send you non-marketing messages about an inquiry you made or services you receive.
Phone. When you submit a form, you agree that we may contact you by phone at the number you provide about your inquiry. We do not send marketing text messages, or place marketing calls using an automatic telephone dialing system or artificial or prerecorded voice, without your separate prior express written consent. We do not share your phone number with third parties for their own marketing.
6. Data Retention
We keep personal information only as long as reasonably necessary for the purposes described in this policy, including to meet legal, accounting, and reporting requirements. In general:
- Inquiries and contact records are kept for the duration of our business relationship and for up to three years after our last interaction with you.
- Client records are kept for the term of our agreement and afterward for as long as required by law or needed to resolve disputes, and enforce our agreements, generally up to seven years.
- Google Analytics user-level data is retained for 14 months. Data collected by Microsoft Clarity and the Meta Pixel is retained according to those providers’ settings and policies.
When personal information is no longer needed, we delete it or de-identify it.
7. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit (HTTPS) and access limited to people who need it to do their jobs. No method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security. If a security breach affects your personal information, we will notify you as required by applicable law.
8. Your Privacy Rights and Choices
For all visitors
Wherever you live, you may ask us to access, correct, or delete the personal information we hold about you, or to stop contacting you. We will honor these requests subject to exceptions allowed by law, such as information we must keep to comply with legal obligations.
U.S. state privacy rights
Residents of certain U.S. states, such as California, Colorado, Connecticut, Texas, and Virginia, may have the following rights under their state’s privacy law, to the extent that law applies to us:
- Access and portability: to confirm whether we process your personal information and obtain a copy in a portable format;
- Correction: to correct inaccurate personal information;
- Deletion: to delete personal information we collected from or about you;
- Opt out: of the sale or sharing of personal information, targeted advertising, and profiling in furtherance of decisions that produce legal or similarly significant effects; and
- Non-discrimination: not to receive discriminatory treatment for exercising these rights.
We do not use or disclose sensitive personal information for purposes that would give rise to a right to limit its use.
How to exercise your rights
Email support@webperties.com with the subject line “Privacy Request” and describe your request. To opt out of targeted advertising, you may also enable the Global Privacy Control in your browser.
- Verification. To protect your information, we will verify your request by matching the details you provide with information we hold. We may ask for additional information for this purpose only.
- Authorized agents. You may use an authorized agent to submit a request on your behalf. We may require written, signed permission from you and may ask you to verify your identity directly with us.
- Response time. We will respond within the time required by applicable law, generally within 45 days, which may be extended where the law permits. We will tell you if we need more time and why.
- Appeals. If we decline your request, you may appeal by replying to our decision with the subject line “Privacy Appeal.” We will respond to your appeal within the time required by law. If you disagree with the outcome, you may contact your state’s attorney general.
Notice to California residents
In the past 12 months, we have collected the following categories of personal information, from the sources and for the purposes described in Sections 1 and 2:
| Category | Examples | Disclosed to |
|---|---|---|
| Identifiers | Name, email address, phone number, IP address, cookie identifiers | Service providers; analytics and advertising partners |
| Professional information | Company name and role | Service providers |
| Internet or network activity | Pages viewed, clicks, scrolling, session replay, referring sites | Service providers; analytics and advertising partners |
| Approximate geolocation | City, region, and country inferred from IP address | Service providers; analytics and advertising partners |
We “share” identifiers and internet activity with Meta for cross-context behavioral advertising, as described in Section 4. We retain each category for the periods described in Section 6. California’s “Shine the Light” law also allows California residents to ask whether we disclose personal information to third parties for their direct marketing purposes; we do not.
9. Children’s Privacy
The Site is intended for businesses and adults. It is not directed to children, and we do not knowingly collect personal information from anyone under 16. If we learn that we have collected personal information from a child under 16, we will delete it. If you believe a child has provided us with personal information, please contact us.
10. Visitors Outside the United States
The Site is operated from the United States and intended for visitors in the United States. If you access it from elsewhere, your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country.
If you are in the European Economic Area, the United Kingdom, or Switzerland, we process your personal information on the following legal bases: your consent (for non-essential cookies and the Meta Pixel, which we load only after you consent); our legitimate interests in responding to business inquiries, marketing our services to businesses, improving the Site, and keeping it secure; the performance of a contract with you or your organization; and compliance with legal obligations. You have the right to access, correct, delete, restrict, or object to our processing of your personal information, to data portability, to withdraw consent at any time without affecting prior processing, and to lodge a complaint with your local data protection authority. Where we transfer your personal information outside your region, we rely on appropriate safeguards, such as the European Commission’s Standard Contractual Clauses or a provider’s certification under the Data Privacy Framework.
11. Third-Party Websites and Services
The Site may link to websites and services we do not control, including the other properties in our portfolio that carry their own policies, and social media platforms. This policy does not apply to them, and we are not responsible for their privacy practices. Please review their privacy policies before providing them with information.
12. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date above. If we make material changes, we will provide notice on the Site or, where appropriate, by email before the changes take effect. Your continued use of the Site after an update means you acknowledge the revised policy.
